Fast Simon services enhance user’s experience with personal, relevant search suggestions and results, product recommendations, and other conversion services. To improve user’s experience, Fast Simon products may collect non-personally identifiable data from users. As you use our services, we want you to be clear how we’re using information and the ways in which you can protect your privacy. GDPR and Fast Simon compliance

The General Data Protection Regulation (GDPR), which came into force on May 25th, 2018, aims to protect the fundamental right to privacy and the protection of personal data of European Union (EU) citizens.

If you are a European resident, you have the right to access personal information we hold about you and to ask that your personal information be corrected, updated, or deleted. If you would like to exercise this right, please contact us through the contact information below.

Information we collect

We collect information to provide better services to all of our users. We collect information in two ways:

  • Information you give us. For example, when you sign up to Fast Simon service, we collect personal information,  like your name, email address, telephone number, etc.  When you make a change on your Fast Simon dashboard, we collect your IP in order to trace back your audit log. This data is for internal tracking use only.
  • Information we collect from your store. For example, non-personally identifiable (Non-PII) data from your store catalog, such as product data.
  • Information we get from your use of our services. Example, when a user conducts a search on a site that is using Fast Simon Magento, we will collect the queries or photos that the user searched.  This type of information is relevant to the use of Fast Simon and includes anonymous non-personally identifiable data such as:
    • Cookies on the user’s device that may be used to provide personalized search experience.
    • Aggregated search term data that is collected to provide user with popular search suggestions.

You are solely responsible for the truthfulness and accuracy of the information which you provide to us.  If the provided information is false, we may disable your account immediately.

How we use the data

We use the information we collect from all of our services to provide, maintain, improve them, and develop new ones. We also use this information to offer users personalized experience– like giving more relevant search suggestions.

When you contact us, we may keep a record of your communication to help solve any issues you might be facing. We may use your email address to provide you our Service, customer or technical support, or inform you about our services, such as letting you know about upcoming changes or improvements. We may also use your information to provide you with direct marketing and promotional messages. For example, we may use contact information such as your email address to send you newsletters, special offers or promotions, or to otherwise contact you about our products or information we think may interest you. If you are located in a jurisdiction that requires opt-in consent to receive electronic marketing messages, we will only send you such messages if you opt-in to receive them. You may opt out of receiving marketing emails by following the opt-out instructions in the email or emailing info@fastsimon.com. We may still email customer service and transaction-related communications, even if you have opted out of receiving marketing communications.

We use information collected from cookies and other technologies to improve your user experience and the overall quality of our services. For example, by saving your searches on a specific site, we’ll be able to provide you with a relevant contextual search history when you return to that site and search again for a similar query.

Choice

Our goal is to be clear about what information we collect, so that you can make choices about how it is used. For example, you can set your browser to block all cookies, including cookies associated with our services, or to indicate when a cookie is being set by us. However, it’s important to remember that our cookie dependent services such as Fast Simon Personal may not function properly if your cookies are disabled.

Information we share

We do not share personal information with companies, organizations and individuals outside of Fast Simon unless one of the following circumstances apply:

  • With your consent, we will share personal information with companies, organizations or individuals outside of Fast Simon when we have your consent to do so
  • For legal reasons, we will share personal information with companies, organizations or individuals outside of  Fast Simon if we have a good-faith belief that access, use, preservation or disclosure of the information is  reasonably necessary to:
    • meet any applicable law, regulation, legal process or enforceable governmental request.
    • enforce applicable Terms of Service, including investigation of potential violations.
    • detect, prevent, or otherwise address fraud, security or technical issues.
    • protect against harm to the rights, property or safety of Fast Simon, our users or the public as required or permitted by law.

We may share aggregated, non-personally identifiable information publicly and with our partners. For example, we may share information publicly to show trends about the general use of our services.

Third Party Websites

Our Service or Site may include links to other websites with privacy practices that may differ from ours. Any information you submit to a website not belonging to us is governed by that site’s privacy statements, not this one. We encourage you to carefully read the privacy statement of any website you visit, and we will not be responsible for the content, privacy practices, or any other aspect of such third party websites.

Information security

We work hard to protect Fast Simon and our users from unauthorized access to or unauthorized alteration, disclosure or destruction of information we hold. In particular:

  • We encrypt access to shared data via SSL encrypted protocols.

We restrict access to personal information to Fast Simon employees, contractors and agents who need to know that information in order to process it for us, and who are subject to strict contractual confidentiality obligations and may be disciplined or terminated if they fail to meet these obligations.

Users in the European Economic Area

Individuals in the European Economic Area (EEA) have the following rights with respect to their personal data:

  • Access. You can ask us to confirm whether we are processing your personal data; give you a copy of that data; and provide you with other information about your personal data such as what data we have, what we use it for, who we disclose it to, whether we transfer it abroad, how we protect it, how long we keep it for, what rights you have, how you can make a complaint, where we got your data from and whether we have carried out any profiling, to the extent that such information has not already been provided to you in this Policy.
  • You can ask us to rectify inaccurate information. We may seek to verify the accuracy of the data before rectifying it.
  • You can ask us to erase your personal data, but only where it is no longer needed for the purposes for which it was collected; you have withdrawn your consent (where the data processing was based on consent); following a successful right to object (see ‘Objection’ below); it has been processed unlawfully; or to comply with a legal obligation to which we are subject. We are not required to comply with your request to erase your personal data if the processing of your personal data is necessary for compliance with a legal obligation or for the establishment, exercise, or defense of legal claims. There are certain other circumstances in which we are not required to comply with your erasure request, although these two are the most likely circumstances in which we would deny that request.

In addition, you can object to the processing of your personal data for direct marketing purposes, which includes profiling to the extent that it is related to such direct marketing without providing any reason. We will then cease the processing of your personal data for direct marketing purposes.
  • You can ask us to provide your personal data to you in a structured, commonly used, machine-readable format, or you can ask to have it ‘ported’ directly to another Data Controller, but only where our processing is based on your consent and the processing is carried out by automated means.
  • Withdrawal of Consent.You can withdraw your consent in respect of any processing of personal data which is based upon a consent which you have previously provided.

Users in California

California residents may request and obtain from us, once a year, free of additional charge, a list of third parties, if any, to which we disclosed their personal data for direct marketing purpose during the preceding calendar year and the categories of personal data shared with those third parties. Children’s Online Privacy Protection Act (COPPA) Compliance

The Service and Site are not directed toward children and you are responsible for refraining from providing us with any personally identifiable information relating to children under the age of 13. We do not knowingly collect any personal data from children under the age of 13. Parents and legal guardians must monitor their children’s Internet usage and to help enforce this Policy by instructing their children never to provide personal data through the Service or Site. If you have reason to believe that a child under the age of 13, without a parent or guardian’s consent has provided personal data to us through the Service or Site, please contact info@fastsimon.com.

Changes to policy

From time to time, we may revise this policy and we will post the revised Policy on the Site. All substantial changes made to this policy will be notified on the Site, at our sole discretion, and will take effect immediately. Your use of the Site or Service after any such change constitutes your agreement to the updated Policy.
